Welcome to Forex-GPT.ai. Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Forex Rates plugin and custom GPT services (the “Service”) on Forex-GPT.ai and operated by ForexGPT LLC, collectively referred herein as Service( or “Company”, “us”, “we”, or “our”).

1. Acceptance of Terms

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms, including our privacy policy and software license. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

2. Communications

By creating an account on our Service, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send.

However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

3. Purchases & Subscriptions

Purchases: If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.

We may employ the use of third-party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

Subscriptions: Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Forex-GPT.ai cancels it. You may cancel your Subscription renewal either through your online account management page (via Stripe) and not by emailing Forex-GPT.ai customer support team.

A valid payment method, including credit card or PayPal, is required to process the payment for your Subscription. You shall provide Forex-GPT.ai with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Forex-GPT.ai to charge all Subscription fees incurred through your account to any such payment instruments.

4. Refunds

Except when required by law, paid Subscription fees are non-refundable unless within the applicable limits of our refund policy. In addition, premium tokens purchased are non-refundable and do not expire. As a result, unused tokens are not redeemable for cash at this time.

5. Content

Content found on or through this Service are the property of Forex-GPT.ai or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us. It is important to note that content by ForexGPT – including trading signals are not intended as investment advice and your usage confirms that content will be used for educational and research purposes.

6. Prohibited Uses

You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:

• In any way that violates any applicable national or international law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
• To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter,” “spam,” or any other similar solicitation.
• To impersonate or attempt to impersonate Company, a Company employee, another user, or any other person or entity.
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
• To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of Service, or which, as determined by us, may harm or offend Company or users of Service or expose them to liability.
• To interfere with the application or service in any way that could limit it for others or that goes against its intended use of operation such as described on this site and provided in example educational videos that we provide.
• Suspicious activity: Please note that we reserve the right to ban users without prior notice if suspicious activity is detected, including but not limited to programmatic login attempts to our service or an unusually high number of login attempts within a short period, or any such actions that we deem in our discretion to violate proper usage of our services that may affect other users, which may result in a temporary or permanent ban of your account.

7. Analytics

We may use third-party Service Providers to monitor and analyze the use of our Service.

8. No Use By Minors

Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using any of Forex-GPT.ai, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of Terms.

9. Accounts

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

10. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Forex-GPT.ai and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Forex-GPT.ai.

11. Error Reporting and Feedback

You may provide us either directly at [email protected] with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Service (“Feedback”). You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) Company may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) Company is not under any obligation of confidentiality with respect to the Feedback. In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant Company and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) Feedback in any manner and for any purpose.

12. Links To Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by Forex-GPT.ai.

Forex-GPT.ai has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites. Note: The founder of Forex-GPT may be employed by certain third-party websites that we link to, this does not imply any endorsement, and the disclosure here is noted for transparency purposes, and not as any conflict of interest.

You acknowledge and agree that Forex-GPT.ai shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such third-party web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

13. Disclaimer Of Warranty

These Services are provided by Company on an “as is” and “as available” basis. Company makes no representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content or materials included therein. You expressly agree that your use of these services, their content, and any services or items obtained from us is at your sole risk.

Neither Company nor any person associated with Company makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the services. Without limiting the foregoing, neither Company nor anyone associated with Company represents or warrants that the services, their content, or any services or items obtained through the services will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that the services or the server that makes it available are free of viruses or other harmful components or that the services or any services or items obtained through the services will otherwise meet your needs or expectations.

The Company hereby disclaims all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for particular purpose. The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.

14. Limitation of Liability

Under no circumstances shall ForexGPT LLC, Forex-GPT.ai or its affiliates, partners, suppliers, or licensors be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your access or use of or inability to access or use the Forex Rates plugin and custom GPT for Chat-GPT, whether or not the damages were foreseeable and whether or not Forex-GPT.ai was advised of the possibility of such damages. Without limiting the generality of the foregoing, Forex-GPT.ai’s aggregate liability to you (whether under contract, tort, statute, or otherwise) shall not exceed the amount of two dollars ($2.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

15. Termination

Forex-GPT.ai may terminate your access to all or any part of the services at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this agreement or your Forex-GPT.ai account (if you have one), you may simply discontinue using the services.

16. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which ForexGPT LLC operates, without giving effect to any principles of conflicts of law. However, in case of any conflict, the laws of the State of Florida shall supersede the laws of any other jurisdiction.

17. Changes to Terms

Forex-GPT.ai reserves the right, at its sole discretion, to modify or replace any part of these Terms and Conditions. It is your responsibility to check these Terms and Conditions periodically for changes. Your continued use of or access to the website following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.

18. Relationship independence

This agreement does not create an employer-employee relationship, a partnership, or a joint venture between the parties. The Provider is not entitled to any employee benefits from the Client. Neither party shall act as an agent for the other nor have the authority to bind or represent the other in any capacity, unless explicitly stated in these Terms.

19. Unforeseeable Events (Force Majeure): In the event that either the Client or the Provider is unable to fulfill their obligations due to unforeseen circumstances beyond their control—such as natural disasters, war, civil unrest, governmental actions, epidemics, or disruptions in essential services—the affected party will be granted an extension to meet their obligations for the duration of the disruption. Financial difficulties do not qualify as such unforeseen circumstances. The party experiencing the delay must:

1. Promptly inform the other party of the onset and nature of the delay.
2. Provide regular updates regarding significant developments and the expected duration of the delay.
3. Endeavor to minimize the impact of the delay by utilizing all reasonable resources and measures available.

21. Software license

Non-Commercial Use: The Software may be used only for personal, non-commercial purposes. Commercial use is strictly prohibited without explicit written permission from ForexGPT LLC.

You may not modify, translate, adapt, or create derivative works based on the Software. Redistribution of modified versions of the Software is not permitted.
